Please read these terms before using our website or purchasing goods from us. These terms do not affect any statutory rights you may have under applicable consumer law.
2. Use of This Website
This website provides information about Golden Hill Nurseries, our plants and products, our nursery and our services.
By using this website, you agree to use it lawfully and not to misuse, disrupt or attempt to gain unauthorised access to any part of the website or its systems.
We reserve the right to update, amend or remove website content at any time.
We make reasonable efforts to ensure that the information on this website is accurate and up to date. However, product availability, prices, opening hours and other information may change without notice.
3. Plants and Products
We offer a range of horticultural products, including container-grown trees and shrubs, hedging plants, hydrangeas, bare-root and root-ball plants, compost, bark mulch and other gardening products.
Many of our plants are grown at our nursery in Kent. Some seasonal plants and products may be sourced from selected third-party nurseries.
All plants are living products and are subject to natural variation. Their appearance, size, shape, foliage, flowering stage and general condition may vary according to the variety, growing conditions and time of year.
Photographs are provided as a guide and may show plants at their best during the growing season. The appearance of an individual plant may differ from the photograph.
Deciduous and some semi-evergreen plants may lose their leaves during autumn and winter. This is a normal part of their seasonal growth cycle and does not necessarily indicate that a plant is unhealthy.
Plant heights, pot sizes, trunk girths and other measurements are provided as a guide. Where precise dimensions are important to your project, please contact us to confirm the specification and availability before ordering.
We reserve the right to correct errors in product descriptions, prices and other website information.
4. Availability of Products
Our stock is subject to seasonal availability and natural growing conditions.
Although we make reasonable efforts to keep our product information accurate, we cannot guarantee that every product listed will be available at all times.
Where a product becomes unavailable after an order has been placed, we will contact you to discuss an appropriate solution. This may include an alternative product, an amended delivery arrangement or a refund, as appropriate.
We will not substitute a materially different product without your agreement.
For large trees, specimen plants, bulk orders or specific planting requirements, we recommend contacting us before travelling to the nursery or placing an order.
5. Prices and Payment
Prices displayed on our website are in pounds sterling (£). Unless otherwise stated, prices include VAT where applicable.
Prices, offers and availability may change without notice. Any change will not affect an order that we have already accepted, except where a correction or other change is agreed with you or permitted by law.
Where products are available for online purchase through one of our specialist websites, the applicable product prices, delivery charges and payment arrangements will be displayed during the ordering process.
Payment must be completed in accordance with the payment arrangements specified for the relevant purchase.
For products purchased directly from the nursery, payment arrangements will be confirmed at the time of purchase.
6. Orders and Contracts
An enquiry, quotation or product listing does not in itself constitute acceptance of an order.
Where you place an order online, you will receive an acknowledgement or confirmation in accordance with the relevant website's ordering process.
A contract for the supply of goods will be formed in accordance with the order process and the applicable terms for the purchase.
We reserve the right to decline or cancel an order where there is a genuine reason to do so, including an error in pricing, lack of availability or an inability to fulfil the order. Where payment has been taken for an order that we cannot fulfil, we will arrange an appropriate refund.
If an order is cancelled, we will explain the reason and any refund arrangements.
7. Delivery and Collection
Delivery arrangements depend on the products ordered, their size and weight, the delivery destination and the relevant ordering website.
Delivery charges and any applicable restrictions will be shown or confirmed before an order is completed.
Plants are living products and may be affected by extreme temperatures and other adverse weather conditions. We may therefore need to adjust dispatch arrangements to protect the condition of plants during transit.
In the event that a delivery cannot be completed because we are unable to contact the customer on the day of delivery (reasons may include but are not limited to the courier being unable to find the premises) the customer may be liable for courier costs including return and re-delivery. For this reason customers MUST supply a valid phone number which will be contactable on the day of delivery.
We will make reasonable efforts to meet any stated delivery estimate. If a delivery is delayed, we will keep you informed where reasonably practicable.
If you wish to collect an order from our nursery, please contact us in advance to arrange collection and allow time for the order to be prepared.
Please ensure that the delivery address and contact details supplied with your order are accurate. You should also ensure that suitable access is available for the delivery vehicle, particularly when ordering large trees or bulk quantities.
Nothing in these terms limits your statutory rights concerning delivery or the remedies available to you if goods are not delivered as agreed.
8. Caring for Plants After Delivery
Plants require appropriate care following delivery or collection. This may include suitable watering, planting, drainage, soil preparation, positioning and protection from adverse weather.
We recommend planting and caring for plants in accordance with the requirements of the particular species and variety.
Plant performance depends on many factors, including soil conditions, drainage, light, temperature, watering, planting technique, pests and diseases.
Unless we have expressly agreed otherwise in writing, we cannot guarantee that a plant will establish, grow to a particular size, flower at a particular time or thrive in conditions unsuitable for that plant.
This does not affect your statutory rights where a product is faulty, not as described or otherwise fails to meet the requirements of applicable law.
If you have concerns about the condition of a plant on arrival, please contact us promptly and provide photographs and your order details where possible.
9. Cancellations, Returns and Refunds
Your rights depend on the type of purchase, the circumstances of the return and whether you purchased as a consumer or for business purposes.
For online and other distance purchases, consumers may have a statutory right to cancel within 14 days of receiving goods, subject to applicable legal exceptions. Where this right applies, we will explain the cancellation procedure and any applicable return arrangements.
Certain goods may be subject to exceptions or special rules under consumer law. We will not assume that a product is excluded from cancellation rights simply because it is a living plant.
Where goods are faulty, damaged, incorrectly supplied or not as described, you may have additional statutory rights, including rights to a refund, repair, replacement or other appropriate remedy.
If you wish to cancel an order, return goods or report a problem, please contact us:
Telephone: 01622 833 218
Email: enquiries@goldenhillplants.com
Please include your order reference, details of the issue and photographs where relevant.
We will explain the next steps and any applicable return arrangements. Refunds will be made in accordance with the applicable statutory requirements and any additional refund policy that applies to your purchase.
Nothing in this section removes or restricts your statutory rights.
10. Advice and Plant Suitability
We are happy to offer general information and guidance to help customers select plants for their gardens and planting projects.
However, the suitability and performance of a plant depend on the specific conditions in which it is grown. You remain responsible for ensuring that your chosen plants are suitable for your site, soil, climate, available space and intended use.
For substantial planting schemes, large trees or specialist landscaping projects, we recommend seeking appropriate professional advice where necessary.
Any advice we provide is based on the information available to us and the circumstances described. It should not be treated as a guarantee of a particular horticultural outcome.
11. Visits to Our Nursery
Golden Hill Nurseries is a working nursery. Conditions underfoot may be muddy, uneven or slippery, particularly during wet weather and the winter months.
Visitors should wear suitable footwear, take reasonable care and follow any safety instructions given by our staff.
Please take care around plants, equipment, vehicles and areas used for nursery operations. Children should be supervised by a responsible adult.
Nothing in these terms excludes liability for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
Opening hours may vary seasonally or on public holidays. Please check the latest information on our website or contact us before travelling if you are unsure whether we are open.
